By accessing or using DuckLinked ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

DuckLinked is a community-driven platform that allows users to track the journeys of rubber ducks through QR codes. Users can find ducks, leave messages, upload photos, and track where ducks have traveled.

3. User Accounts

To access certain features of the Service, you may need to create an account. You agree to:

• Provide accurate and complete information when creating an account
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

4. User Content

You retain ownership of content you submit to DuckLinked (messages, photos, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.

You agree not to submit content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Is defamatory, vulgar, obscene, or invasive of privacy
• Infringes on intellectual property rights of others
• Contains spam, advertising, or promotional material
• Contains malware, viruses, or harmful code
• Impersonates any person or entity

5. Duck Ownership

Physical rubber ducks purchased through DuckLinked become the property of the purchaser. However, once a duck is released into the world, it is intended to be found and passed along by others. DuckLinked is not responsible for lost, damaged, or stolen ducks.

6. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

• Use the Service to violate any laws or regulations
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service without permission
• Collect or harvest user data without consent

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUCKLINKED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless DuckLinked and its operators from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.
